Terms of Service

1. Introduction
These Terms of Service ("Terms") govern the freelance software development services provided by Juan Cabrilla Arenal ("Developer", "I", "me"), operating from San Nicolás del Puerto, Spain, to clients ("Client", "you") who commission Android application development services.
By engaging my services, you agree to be bound by these Terms. Please read them carefully.
2. Services
I provide Android mobile application development services including but not limited to:
- Design and development of new Android applications
- MVP (Minimum Viable Product) development
- Modification and improvement of existing applications
- API integration and backend connectivity
- Google Play Store submission and management
- Post-launch support and maintenance
Specific deliverables, timelines, and scope are defined in individual project agreements or statements of work agreed in writing before work commences.
3. Payment Terms
3.1 Deposit: All projects require a 50% deposit before work begins. This deposit is non-refundable once development has started.
3.2 Final Payment: The remaining 50% is due upon delivery of the final product, before source code transfer.
3.3 Accepted Methods: SEPA bank transfer, PayPal, Bitcoin (BTC), or Ethereum (ETH) at current market rate on payment date.
3.4 Late Payments: Invoices unpaid after 14 days from the due date may incur a 2% monthly late fee.
4. Intellectual Property
4.1 Client Ownership: Upon full payment, the Client receives full ownership of the custom code developed specifically for their project.
4.2 Third-Party Libraries: Applications may include open-source libraries which remain subject to their own licenses. A list of all third-party dependencies will be provided upon delivery.
4.3 Developer's Rights: I retain the right to showcase the project in my portfolio (with client permission) and to reuse generic, non-proprietary code patterns in future projects.
5. Project Timeline & Revisions
5.1 Timelines: Estimated delivery dates are provided in good faith. Delays caused by late client feedback, scope changes, or force majeure are not my responsibility.
5.2 Revisions: Each project includes a reasonable number of revisions as defined in the project agreement. Significant scope changes will be quoted separately.
5.3 Client Responsibilities: Clients must provide all required assets, content, API credentials, and feedback within agreed timeframes.
6. Warranty & Support
I provide bug fix support for the period specified in the project agreement (minimum 14 days, typically 30 days after delivery). This covers bugs in the delivered code — not issues arising from third-party API changes, OS updates, or modifications made by the client.
7. Limitation of Liability
To the maximum extent permitted by law, my total liability for any claim arising from these Terms or the services provided shall not exceed the total fees paid for the specific project in question. I am not liable for indirect, incidental, or consequential damages.
8. Confidentiality
I treat all client information, business ideas, and project details as confidential. I do not share or disclose project information to third parties without written consent, except as required by law.
9. Governing Law
These Terms are governed by the laws of Spain. Any disputes shall be subject to the jurisdiction of the courts of Seville, Spain.
